TR20 Limited Terms of Trade / Terms of Conditions

The Terms of Trade/ Terms of Conditions set out below govern all of the supplies of goods & services (“products”) from TR20 Limited (TR20 Ltd) to the customer.

 

These will replace any Terms of Trade/ Terms and Conditions contained in any document used by our customers and purporting to have contractual effect, and your acceptance of any products from TR20 Limited indicates your acceptance of these Terms of Trade/Terms of Conditions.

Vehicles and their contents are left entirely at owners risk

1.0 Our Pledge to you.

1.1 We undertake to carry out the work requested in a professional manner & to comply with industry

standards.

1.2 Should it become apparent that additional work is required, we will discuss this with you before incurring

added costs

1.3 We Strive at all times to complete your work in the time frame given, however from time to time there may

be delays outside our control, we will advice you as soon as any such delays become apparent.

1.4 If requested & whenever possible we will provide you with an estimate or quotation .

2.0 Pricing & Payment Terms.

2.1 Prices shown on the TR20 Limited website are in New Zealand dollars. In some cases, the prices shown

may only be valid on the website and not in store.

2.2 We reserve the right to change or alter any prices at any time for any reason.

2.3 In all cases payment is required on completion of the work, or unless arranged with TR20 Limited.

2.4 In the unlikely event that an invoice becomes overdue it is agreed by the debtor that they can be charged a

penalty interest of 2.5% per month or for all costs of collection including any court costs.

2.5 All goods & materials remain the property of TR20 Limited until paid for in full & we reserve the right to

register our financial interest on the Personal Property Securities Register until final settlement

2.6 Payment defaults may be passed to another party for credit reporting purposes.

3.0 Content, Product Range & Availability

3.1 While we endeavour to supply correct information on our or social website at all times, mistakes, errors and

omissions may occur. TR20 Limited or its company members’ takes no responsibility for any loss or

damage, direct or indirect, resulting from information contained on this site.

3.2 Whilst we endeavour to action purchases promptly, any goods purchased from our website outside of

trading hours can only be processed on the next business day to the best of our ability, (allow for a delay

while we may be out of the country)

3.3 The products advertised are subject to availability and can change with out notice. If we are unable to

supply the advertised product, arrangements will be made to supply an equivalent product, or if you prefer,

a full refund will be made.

3.4 Pictures of products are for illustrative purposes only, actual product may vary.

3.5 All efforts will be made to fulfill any order placed with TR20 Limited.

However, we accept no responsibility should we be unable to supply goods ordered for any reason.

 

 

4.0 Storage Terms

4.1 If a bike is not collected within 7 full days from work being completed & invoiced then a $10 per day

storage fee will apply.

4.2 Storage of your Motorcycle & Property at TR20 Limited is at Owners risk.

 

5.0 Liability

5.1 If we fail to comply with these conditions, we will attempt to repair the issue for you as soon as possible,

which may include providing you with replacement parts.

5.2 Under no circumstances will we be liable to you for any indirect or consequential loss, damage or expenses

while the vehicle is at TR20 Limited, or there after (including loss of profits, business or goodwill, stress or

inconvenience).

5.3 In the event there is an issue from a service & you have contacted TR20 Limited within the specified time

frame of the service (see section 8.4 ), and both parties can not come to a mutual agreement of repair or

replacement other than to refund to you the amount paid by you for the service to the limit of the parts cost

only on the invoice provided by the customer.

5.4 In the event that the parts used have malfunctioned by manufacture defect, or that you have not notified

TR20 Limited with in the specified time frame, or tried all possible ways of contacting TR20 Limited, by

ways of email, phone, text, social media, extended family or friends etc of an issue with the service, we

shall have no liability to pay any money to you by way of compensation for such issue.

5.5 Nothing in these terms and conditions is intended to limit any of your statutory rights or in any way to

exclude or limit our liability to you for any death or personal injury resulting from our negligence

5.6 TR20 Limited is a functioning workshop and is a multiple hazardous area, we have set up warnings at the

gate to notify you that you enter at our own risk, and TR20 Limited and its members take no responsibility

or liability for any accidents or incidents whilst on the property/ workshop.

5.0 Social Media / Non-Disparagement

5.1 No photos shall be taken of the workshop & surrounds unless prior consent from TR20 Limited, No photos

shall be posted on Social media unless prior consent from TR20 Limited.

5.2 Advise TR20 Limited if you allow consent of your motorcycle to be photographed & a service brief

advertised on TR20 Limited Social Media Pages

5.3 You the client or any acquaintance of the a client, before, during or there by after a service, quote or any

dealings with TR20 Limited will not disparage or defame TR20 Limited or its members in any respect or to

make any derogatory comments, whether written or oral, regarding TR20 Limited or its current or former

officers, directors, employees, attorneys, agents, or contracting parties, or its business or operations.

If mediation about such issue can not be obtained by both parties, then an action lawsuit will follow.

 

 

6.0 Consumer Guarantees Act

6.1 If the Customer is a consumer under the Consumer Guarantees Act 1993 (the “Act”) & acquires or holds

itself out as acquiring goods or services from TR20 Limited for the purposes of a business then the Act will

not apply and is expressly excluded. Subject to this clause nothing in the Terms and Conditions will affect

Customer’s rights as consumer under the Act.

7.0 Governing Law

7.1 If any parts of these terms of trade/terms of conditions shall be held to be illegal, unenforceable or invalid,

the remaining parts shall continue in full force and effect.

7.2 The laws of New Zealand shall govern these terms of trade and TR20 Limited, and the client hereby submit

to the non-exclusive jurisdiction of the courts of New Zealand. The client hereby waives and right they may

have to claim that the above submission to jurisdiction is an inconvenient forum.

 

 

8.0 Warranty & Returns

8.1 Goods are warranted free from defective workmanship and material provided that the goods are unmodified

in anyway and are used for the purpose intended by the manufacturer. The warranty covers replacement or

repair of the product itself.

8.2 Warranty on new parts will not be extended beyond that of the manufacturer's warranty period or

conditions.

8.3 No warranty on used or reconditioned parts, whilst they are checked & tested to be safe, there is no

warranty and TR20 Limited take no responsibility or liability or any accidents or issues there after mounting

or fitting.

8.3 The warranty is limited to replacing or repairing any defective goods returned to TR20 Limited in

accordance with the procedure set out in these terms and conditions provided that TR20 Limited is

satisfied that the defects were defects in manufacture and not due to in ill handling, fair wear and tear,

improper use, misuse or modification of the product by the customer or someone other than TR20 Limited.

8.4 You have 14 days to make contact regarding ill workmanship or problematic issues directly relating to the

service or repair of the vehicle service that was performed.

8.5 Customers have the right to return any good deemed faulty in nature.

The following conditions apply to returned items:

Where goods/retail products are being returned due to a fault, they must be in original condition

Proof of purchase must be provided

Where return is due to a fault, the customer must contact TR20 Limited within 14 days of receiving the

product.

8.6 Retail product exchanges for a better preferred size are subject to their availability.

Exchanges or returns may made only if arranged with in 14 days of receipt, with purchase recipe, and

in original packaging, item to be unused or excellent condition,

Please not original packaging as received.

 

 

9.0 Privacy/ Personal Information

9.1 Through normal business, TR20 Limited may collect customer information including contact and delivery

details and purchase history. This information will remain confidential and will be held securely, and will not

be disclosed to any third party without written consent of the owner on the customer details form, except in

cases where the information is necessary to carry out the transaction entered into by the customer.

9.2 Customers who do not wish to have any personal information collected and used for any other purpose

other than that required to complete the transaction will need to express this on the customer form provided.

 

 

10.0 Acceptance / General

10.1 Any instructions received by the customer for the supply of goods & or services, shall constitute

acceptance of the terms & conditions contained here in. A Signature is not required.

10.2 TR20 Limited reserves the right to change these terms of trade from time to time.

11.0 SC-Project information.
The costs include international exchange rates, all shipping, handling & delivery to your door.

These pipes are generally made to order, unless you have a super popular model and are in stock in SC-Project Oceania Warehouse in Perth.

But for the most part for backordered items, we do offer our 'backorder' customers the opportunity to secure the exhaust of preference with a $200.00 deposit, and the remaining amount would only be requested upon arrival to SC-Project Oceania (located in Perth), prior to dispatch to NZ.
The turnaround time for back-order items can vary between 5-12 weeks approx.
Which generally represents the best- and worst-case scenarios entirely determined by global demand that the Factory have to contend with because SC-Project is hand-made to order so each pipe is very special.

For Perth in-stock items, payment is required in full prior to sending from the warehouse,
From Perth Warehouse shipping eta is approx. 1-2 weeks to TR20 in NZ, at present due to Covid Restrictions with limited flights etc to NZ

Both back orders, or in-stock item prices are current & valid for 7 days from contact, thereafter, we would need to review costs due to ever changing global exchange rates.


If our offer is of interest to you, we would require the following information confirmed in writing:
 
•           Full Name
•           Delivery Address (including business name if it is going to a commercial address)
•           Contact Phone Number
•           Exhaust option
•          Bike Rego or Vin Number. (including year model, if possible)
 
With this information it will enable us to generate an invoice for the deposit amount of $200.00, or full amount for in-stock items,
Once paid, your exhaust of preference would be placed on backorder with the Factory (orders go to the factory on Mondays), or if in-stock arranged to ship from Perth Warehouse to TR20 in NZ.

Our return policy is absolutely no hassle to our customers at all.

We allow returns if you are unfortunately dissatisfied with the SC-Project item you have purchased or if it did not meet your expectations.

However, we only accept returns within 30 days upon the shipping date. We will provide you with a refund or replacement.
If the item does not have any factory defect or damage, returns have a 20% restocking fee.
If a back-order item is canceled prior to dispatch, but after manufacture, the 20% re-stocking fee still applies.
In some instances, we may not accept your return request, mainly if the orders or items are not in demand.
To be specific, the items that you would like to return or get a refund for should be returned in their original, sellable condition. It means that you include the original packaging, installation guide, and all stickers intact.
SC-Project Oceania reserves the right to determine if you qualify for the return or replacement. As long as the item is in its new or sellable condition, is not fitted to a bike, and never used, you could easily file for a refund. Please make sure that you are aware of our guidelines before returning the merchandise.
